Terms of Service

Last updated: October 28, 2026

1. Agreement

These Terms of Service (“Terms”) govern your use of Santa Ride, including santaride.app, its subdomains, event pages, and embeddable widgets (the “Service”), which is operated by Continuance Labs LLC (“we,” “us”). By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service for a fire company or other organization (an “Organization”), you agree on its behalf and confirm you are authorized to do so. If you do not agree, do not use the Service.

2. Pilot service

Santa Ride is in an early pilot. Features may be added, changed, limited, or removed at any time, sometimes without notice, and some features may be labeled as previews. We may suspend or discontinue all or part of the Service. We do not promise any particular availability, uptime, speed, or response time, and the Service may be interrupted, for example for maintenance or because of problems with providers we rely on.

3. Not for emergencies or safety-critical use

The Service is an event planning and community communication tool. It is not an emergency dispatch, emergency communication, navigation, or public-safety system, and it must not be relied on for any of those purposes.

Live locations, estimated arrival times, routes, directions, maps, and notifications may be delayed, inaccurate, incomplete, or unavailable. They depend on devices, GPS signals, cellular networks, and third-party map and routing data that we do not control. Event times shown to the public are estimates, not commitments.

4. Accounts

You must provide accurate information, keep your password secure, and tell us promptly at admin@santaride.app if you think your account has been used without permission. You are responsible for activity under your account. Organization owners and administrators control who can access their Organization and what role each member has. You must be at least 18 to create an account.

5. Organization responsibilities

Organizations that use the Service to plan and run events are responsible for:

  • Their events and everything that happens at them, including the safety of participants, crews, and the public
  • Obtaining any permits, permissions, road closures, traffic control, and insurance their events require, and complying with laws and their own policies
  • The accuracy of the information they publish, including routes, stops, and times
  • Having a lawful basis and any required consent for the personal information they add or collect, including volunteer and contact details and reminder lists, and using it only as the law allows
  • Reviewing photos and other community submissions before approving them, including obtaining any permission needed to publish images of identifiable people, especially children
  • Moderating their event chat

6. Your content

You keep ownership of the content you and your Organization put into the Service, such as event details, routes, logos, photos, and messages (“Your Content”). You give us a non-exclusive, worldwide, royalty-free license to host, store, copy, display, and process Your Content as needed to operate, secure, and improve the Service, including publishing it on event pages and widgets when you or your Organization choose to publish. This license ends when Your Content is deleted from the Service, except for copies in backups kept for a limited time and content others have already shared.

You confirm you have the rights needed to share Your Content and that it does not violate anyone else's rights or the law. Members of the public who submit photos or chat messages to an Organization's event grant the same license to us and to that Organization for use with that event.

7. Acceptable use

You may not:

  • Break the law, or post content that is unlawful, harassing, hateful, sexually explicit, or that exploits or endangers minors
  • Impersonate a person or organization, or create an Organization you are not authorized to represent
  • Send spam, or upload anything containing malware
  • Access other Organizations' data, probe or test the Service's security without our written permission, or get around rate limits, bot protection, or access controls
  • Use automated means to create accounts, submit forms, or collect data from the Service
  • Interfere with or overload the Service
  • Copy, resell, or reverse engineer the Service, except where the law allows

We may remove content and limit access to enforce these rules.

8. Plans and payment

Some features are available on a free plan, and others may require a paid plan. Plan features and limits are described on our pricing page and may change.

When paid plans are offered:

  • Paid plans are billed yearly in advance through our payment processor, Stripe.
  • Subscriptions renew automatically each year at the then-current price until canceled. We will give you advance notice of any price change before it applies to a renewal.
  • You can cancel at any time from your billing settings. Cancellation takes effect at the end of the current paid year, and you keep paid features until then.
  • Fees are non-refundable except where required by law or where we decide otherwise.
  • If a payment fails, we may move your Organization to the free plan's limits until payment is made.
  • You are responsible for any applicable taxes.

9. Third-party services

The Service relies on third-party services, including maps, routing, email, payment, and push notification providers. Their availability and accuracy are outside our control, and your use of them may be subject to their own terms.

10. Suspension and termination

You can stop using the Service at any time. To have your account deleted, email admin@santaride.app. We may suspend or end your access if you break these Terms, if your use creates risk or legal exposure for us or others, or if we discontinue the Service. Where reasonable, we will give notice and a chance to export your Organization's data. Sections that by their nature should survive termination (including 3, 6, and 11 through 15) survive.

11. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties that the Service will be uninterrupted, timely, secure, error-free, or accurate, that data will not be lost, or that defects will be corrected.

12. Limitation of liability

To the fullest extent permitted by law, Continuance Labs LLC and its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or use, arising out of or related to the Service or these Terms, even if advised of the possibility. Our total liability for all claims arising out of or related to the Service or these Terms will not exceed the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you.

13. Indemnity

You and your Organization will defend and indemnify Continuance Labs LLC against claims, losses, and expenses (including reasonable attorneys' fees) arising from Your Content, your events, or your violation of these Terms or the law.

14. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Virginia, and you and we consent to their jurisdiction.

15. General

We may update these Terms. We will post the new version here with a new “Last updated” date, and if a change is significant we will give account holders notice, such as by email or in the app. Continuing to use the Service after a change takes effect means you accept it. These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition, or sale of assets.
